Banking & Financial Services We are fully abreast with current finance and banking developments and are able to advise on the formulation and implementation of banking products and financial instruments and engage in the preparation and review of financing and security documents. CONSTITUTIONAL AND ADMINISTRATIVE Government action regularly affects the interests of individuals and businesses through legislation and the operation of a wide array of legislative and administrative orders. We provide counsel to and represent our clients in administrative and judicial proceedings seeking constitutional protection from the acts of the federal or provincial governments or bodies/organizations that are organs or act under the aegis of the federation or the provinces. EMPLOYMENT, LABOUR & INDUSTRIAL RELATIONS We have substantial experience in advising employers on all aspects of labour and employment law, including the recruitment, retention and retrenchment of staff, the transfer of employees, the negotiation and drafting of collective bargaining agreements, wrongful dismissal advice, pension and benefits litigation, worker�s compensation, drafting individual employment contracts and consultancy agreements and advising on disputes over executive contracts and compensation. We are also adept at successfully handling employment/labour disputes before the High Courts, Federal Services Tribinal, National Industrial Relationship Commission and Labour Courts. INTELLECTUAL PROPERTY In the competitive business environment of today the protection of intangible assets such as brands, copyrights, trademarks, patents and designs is becoming increasingly important. Our practice encompasses the complete spectrum of IP issues and we are able to advise on the registration, management and protection of IP portfolios and on transactional work involving intellectual property rights, including the assignment of trademarks, patents, copyrights, and registered designs, research and development, marketing, product development and distribution agreements and other intellectual property and technology-based associations. We are also able to conduct litigation concerning any disputes that may arise involving patents, trade marks, unfair competition/passing off, copyrights, designs and trade secrets including combating piracy and counterfeiting; including questions of ownership, validity and infringement. LITIGATION & DISPUTE RESOLUITON We handle a wide range of civil disputes and proceedings as well as white collar crime and criminal proceedings arising in a corporate context and have particular expertise in managing complex, multi-faceted cases involving multiple claims and parties. We also deal with a variety of administrative law matters that frequently involve proceedings for judicial review. We pride ourselves on our ability to deal with the same in an efficient and dynamic manner, departing from the mechanical and often pedestrian style of litigation that is generally prevalent, and work to help our clients resolve disputes efficiently and effectively � whether through arbitration, litigation or other techniques � in a manner that promotes their business objectives. We are also able to work with clients to develop compliance programs and other techniques to minimize the potential risk of future litigation. The specific areas in which we have expertise include handling and advising on all litigation related aspects of commercial transactions; supporting and advising on investigations and disciplinary proceedings by regulatory authorities; protecting intellectual property rights such as copyright, trademarks, designs and patents, defending defamation and libel claims; handling contractual and development disputes, landlord and tenant disputes, secured lending matters, rent review matters, nuisance and trespass action, and liquidation, insolvency and receivership matters involving property arbitration proceedings. Conducting litigation on behalf of banking and non-banking financial institutions, including but not limited to matters relating to the recovery of finances under the Financial Institutions (Recovery of Finances) Ordinance 2001, criminal offences in respect of banks and contentious disciplinary matters before the competent regulatory authorities; handling employment disputes in the High Court, Labour Courts/Tribunals and the Labour Appellate Tribunal; advising property owners, investors, developers, occupiers and banks on the whole range of contentious property issues, including landlord and tenant disputes, rent reviews, nuisance claims, possession actions, rent and service charge recovery, insolvency (both landlord and tenant), and conveyancing disputes. TAXATION We are able to advise on and deal with litigation concerning income tax, sales tax, customs duty, stamp duty, central excise duty, and fees, and have had considerable success in mounting challenges to the wrongful collection of amounts under these heads before the courts. COMPANY/COMMERCIAL Partner and associates of Waqar Law Associates have substantial experience in the full range of corporate transactions from business start-up to public company flattens on the Stock Exchange. We advise on mergers and acquisitions, corporate finance securities transactions and banking laws. GENERAL COMMERCIAL WORK The firm advises on a very wide range of commercial agreements in various business sections. Specialist areas include production sharing and operation agreements other than distribution, agency, partnership, licensing and royalty agreements. INSOLVENCY AND RESTRUCTURING We advise in relation to corporate restructuring and refinancing which frequently include transactions involving hive-downs and asset sales by, for example, receivers or liquidators. Contentions elements relating to insolvency are dealt within close liaison with the litigation department. COMMERCIAL DISPUTE; PAKISTANI AND OVERSEAS LAW. The firm�s substantial overseas clientele and the regular negotiation of contract and resolution of disputes outside the Pakistan gives us wide experience in dealing with other legal jurisdictions and in advising on international issues of law. DEFAMATION The firm deals on a regular basis with defamation actions for both individuals and corporations. PROPERTY LITIGATION We advise on property related litigation matters including business tenancy renewals, dilapidation claims and forfeiture. TRUSTS We are able to advise upon and work towards the establishment of private, charitable and commercial trusts, advise established charities, advise trustees on commercial transactions, and also advise on the uses and implications of trusts in various commercial situations.
