A dog bite is a strict liability claim. A dog owner is strictly liable for dog bites unless your daughter was trespassing, teasing, tormenting, abusing the dog.

The homewoner's insurance policy is the appropriate insurer in which to file a claim.

I would encourage you to have an attorney assist you with this claim, usually an attorney would be paid from the proceeds of the recovery or settlement of the claim. However if you wish to handle it yourself, you should ask the dog owner for his/her insurance information and contact the insurer's claims department.

I'm sorry to hear that your daughter was bit by a dog, and I hope she is making a full recovery. As the others have said, it is recommended that you hire an attorney to deal with the homeowner's sophisticated and aggressive insurance company.

You will need to notify the homeowner of your claim, and it is their job to notify their insurance carrier. The insurance company should then step in and handle/defend against your claim. If there is a mortgage on the homeowner's property, they will be required to have homeowner's insurance. If you are not getting anywhere, you will simply need to file suit against the homeowners.
