Liability insurance policies in California typically have a $15,000 minimum limit. It sounds like this "offer" of $5,000 may just be part of a medical reimbursement portion of the other driver's policy. Or, it's possible that your father has "Med-Pay" under his OWN insurance policy and they are simply offering this as payment under his policy.

He needs to find out for certain BEFORE signing ANYTHING.

I think he should consult with an attorney to discuss his options.

I used to work in claims before becomming an attorney and I understand how they think. Many insurance companies including but not limited to Mercury would make a rediculous offer regardless of the injuries or damages, not caring what you think or do.
