Legal Question

My friend (US citizen) married a man (US citizen) in Guatemala; they reside in Texas. They never filed anything w/ the county clerk here validating their marriage. If they were only 'common-law' married in Texas and never filed anything w/ the county clerk, do they need an official divorce in Texas?
