Sue them both before it is too late. More than likely they both have some percentage of liability to you, but if you don't sue before the statute of limitations runs out, neither will have to pay you. If the bus was owned by a public agency, your time limits are VERY short for filing a Government Code claim, and then a lawsuit.

I'm sorry that you have to endure the consequences of someone else's mistake, whether the bus driver's or the truck driver's.

There is a statute of limitations, i.e., the time in which you have to file a lawsuit or you lose your rights.

When dealing with governmental agencies, which typically INCLUDE public buses, you must file an official claim within a very short period of time. Failure to do so can result in the loss of all rights.

Therefore, you want to contact an attorney to act on your behalf as soon as possible. You also want to make sure that you are receiving proper medical treatment.

As previously stated, you will needcto sue them both and let them fight it out. You will need to file a notice of claim form with the bus company within 180 days of the accident as it is required when you are making a claim against a governmental entity, but I would not delay on that...file it ASAP.
