Legal Question

Hi I did a photo shoot, me as the photographer, and my subject used my photo to promote his local TV show and has told me through email that he knows he wasn't supposed to use my photo but still uses it for advertising. Do I sue Him or the magazine TV show he works for? Do I have a case? I have ALL the proof for my case.
