Legal Question in Banking Law in India

Hello All,

I have taken DD from a Bank. And it is now expired. The D.D was not encashed. Actually it was lost when it is sent through post. Now the person for whom the D.D is meant for is not giving indebt form. So Im not able to get back the money. Bank is mandatorily asking for indebt form to remitt the amount. Is there any other way to get the amount back. I dont have the D.D and the person is not willing to give Indebt form, What to do.

Dear Sir / Madam,

You should submit an Indemnity Bond to the Bank stating that you remain solely liable to any third party should any claim arise on account of the Demand Draft and submit the original Demand Draft with a letter requesting the Bank to cancel the Demand Draft and credit the proceeds thereof to your Account.
