dear sir,

one person told my husband i buy new car then we are give 80 000 /- 2011 but the person your my money own use so i am asking they say i have not money i give late so tell me i am women middle class family how to i comoplaint police station and he gave me cheque also its already bounce please tell me and give me suggetion

Query : One person told my husband that I brought a new car and for which we gave him Rs. 80,000/- cash which he usurped for his personal usage. When I ask that person now he denies having received the money from us and says that we did not give him the money in time to book and purchase the car for me. The cheque given by him in return for Rs. 80,000/- has already bounced. Please advise me and suggest a solution.

Answer : Since the person has issued a cheque refunding the amount, there is no question of him denying that he has received the cash from you for booking and purchase of the new car. Now that the cheque he has issued in refund has bounced, should the person not immediately return back your amount, you will need to lodge a Police complaint and simultaneously file a "cheque bouncing" case against the person under Section 138 of the Negotiable Instruments Act, 1881.
