Legal Question in Business Law in Maldives

Giri is 17 years old and wants to buy a laptop. She has visited many shops selling laptops to consider which laptop to buy. She decides to buy a laptop from a shop belonging to Tobias for RM1,500. Tobias offers Giri a promotion that she can pay for the laptop by instalments of RM500 for 3 months. Giri thinks she can afford this by saving money from her allowance for the next 3 months. Giri pays the first instalment, but does not pay the remainder as Giri actually now finds that she prefers another model instead sold by another shop. Tobias argues that Giri is legally bound by a contract with him to complete the instalment payments.

Advise Giri whether she has the capacity to enter into this contract.

Dear Sir / Madam,

Giri being more than 15 years of age, has the capacity to enter into this contract. Tobias' argument is legally valid and enforceable. Giri remains liable to pay up and settle the remaining two installments to Tobias. At the most, if Tobias agrees, Giri has to return the laptop back to the Tobias at the depreciated value and pay up the balance amount and close the deal i.e if Tobias assigns a depreciated value of say RM 900/- for the return of the laptop, Giri will have to pay RM 100/- to Tobias to close the deal.
