Legal Question in Civil Rights Law in India

Hi,

My Grandfather had 4 sons and a daughter. Grandfather had land which he purchased.

My father used to live at some other place but used to frequently visit his parents. My grandparents died without the will. So brothers divided the land on mutual understanding. All those who used to live there were given part of land which had rooms and my father got empty land.

After 5 years brother who got neighborhood land to my father started encroaching my father's land.(Since we do not live there).

Now he also started threatening my father.

Land is still on my grandfather's name so he says this land does not belongs to you and is mine. He says since you do not live here this land does not belongs to you.

He says you do not have any papers to prove your claim.

What should we do?
