iam priya iam a widow . my husband's property is in madurai. we are 6 share holders. we five share holders is in madurai and i am in chennai. the sixth share holder is in france. now we are going to sell the land in madurai. we six are ready to sell the land . but what is the problem is the sixth share holder cant come to india to sign the property in time , in that situation can we deposit their amount of share in a court? is there any possibility. if there is any option tell me the points to do. thanks & regards priya.

Hello Ms. Priya

The 6th Sharer, can execute a Power of Attorney in favor of any other sharer to sign and execute the Sale Deed on his behalf. This Power of Attorney has to be attested / legalized by the Indian Embassy in France.

Based on this Power of Attorney, the Attorney Holder can execute a Conveyance on behalf of this 6th Sharer, and also receive the money on his behalf.
