Hi sir...we Buyed 3 acres of Land .Actually this Survey number area is 4 acres.Earlier road was laid in One acre.We agreed to buy remaining 3 acres.Unfortunately there is a mistake in sale deed.East Boundary is wrongly written.Instead of Road it was written as neighbours name.After 25 years seller claimed that he seller land along with road and occupied one acre land.Can you suggest legally

Dear Sir

The Sale Deed has to be read as a whole, Identification of the property will be determined by considering all the factors i.e. Area, Survey No. boundaries, the holding of the seller etc. Merely one factor of wrong description of the boundary property would not make the sale deed void, or put the title qua the land under cloud.

So, if the sale deed otherwise property describes the property, or the actual property can be correctly identified, then such error in the sale deed would not make difference.
