What wife can do,if husband hack her email account to get Resume from her

E-mail-Id to proof her employment in court,But on the other side,Wife has left the job 6months back,before filing the maintainence case in court.?

Can we lodge other case under IT act of HACKING Besides MAINTAINENCE Case?
