Legal Question in Construction Law in India

A G+1 constructed building with separate deed, on later date a staircase has been construct by one of the owner by taking a lump sum money from the other Ist floor owner and passed a addition & alteration building plan on his name, question who is the actual owner of the stair case.

No individual is the owner of the staircase as it comes under the definition of common amenities and facilities as per law.
