Legal Question in Construction Law in Pakistan

Salam

I live in a village where there is a barsati naala in front of our house and whenever its rain heavily too much of water start running in it and its difficult for us to cross we want to construct a small culvert on it but A person in our neighbour claim that he owns this naala land and he is not letting us to construct we are in trouble is there any Legal advice in our favour plz help
