Legal Question in Consumer Law in India

I had taken a health policy from Star Insurance on December 19th 2013. Unfortunately on 12th January 2014, i had to undergo appendicitis operations without any previous symptoms. The company has not issued any medical test paper to me (age 57) until i collected the same on 20th January 2014. i submitted the claim. Now the Star Insurance company is telling that since the operation took place within one month of the issue of policy, the claim is rejected. There is no record of the company giving me this clause. Kindly advise what should i do? Is there any such condition in convention even without the company communicating this condition. Until they got the cheque, their representaive was calling me every day and after cheque was given, they he was out of job and removed and thats why there was delay in sending me the receipt etc etc. please advise next course of action from my side against Star Insurance Company, Bangalore.

Dear Sir / Madam,

The Star Insurance Company is legally bound to acknowledge, honour and settle your claim. No, the Company ought to have specifically mentioned in the terms and conditions of the Policy, that claims if any will only be effected for any medical illness after the first month. You should tell the Star Insurance Company that delay in issuing the receipt is the Company's problem and you are not to be penalized for it.
