Legal Question in Consumer Law in India

I purchased a Toshiba satellite series laptop on 11 aug 2012 for my daughter's engineering education. She was studying in Guindy Anna University Campus, Chennai.

The Toshiba Laptop was fine for the first few months but suddenly one of the closing handle hinges was cracked led to non opening of Laptop for atleast a month till it was rectified. The issue was raised with the Redington service center, Chennai for which they casually informed that these problems were common and occur in satellite series.

Three months later, the other side of the handle hinges cracked for which the complete bottom portion of the laptop has been changed.

Now, the functioning the of the laptop has again come to an halt. It emanates an unbearable noise and beep sound on opening. The service center told that the warranty has expired and i have to pay for replacing any of the internal parts which may go up to Rs.10000.

Faulty, poor quality construction made Toshiba's product's lifetime poor lasting not more than a year. It should not affect me under any circumstances and make me to incur expenses and mental agony.

So, I request them for an immediate replacement of the total product by a new one was turned down and when I asked for the replacement of parts at their cost which they fix approx. Rs10000/- Ten thousand, it was again turned down saying I must bear it.

Please advise.

you may approach consumer court but your case is not solid, but it is your luck, may be you get your solution. coz you should have file the case during guarantee was pending.
