Legal Question in Criminal Law in India

1 person placed an order online on www.dominos.co.in for few eatable products amounting Rs. 400 and opted to pay online through his bank account with HDFC Bank net banking. The amount debited but the accused never delivered as product against the product as to do so and force him pay once again for the said order by cash. the staff members promised him that they have not debited the money but bank account verified it found the same, then manager promised him refunded but over 7 days amount was not refunded. It is under section 406 IPC or related to consumer protection act
