Legal Question in Criminal Law in India

Dear Sir,

I am Dr. Mayank Gupta. I have few queries. I will be highly obliged if you can guide me with this.

We had a land in Kanpur in the name of my mother which my mother recently sold it to a policeman.

He gave us cheques out of which the last one with amount 1 lakh got bounced from the bank.

I got the cheque back from the bank and the reason is given on the Cheque is "Insufficient funds".

Now that person is asking us to wait for one month and he will put the amount in his account.

But as he is police man we dont trust him for this. When we asked for urgent money he said i will not give,

do whatever you can.

These all things happened in last 10 days. Now we are planning to wait for one month as he has said because we have no option.

Can i take a legal action against that person to get the amount?

Please guide me how to proceed in this direction.

please serve him with a legal notice under sec 138 NIA. If you wait for a montyh the limitation to file the case will expire and this is what he knows and is asking you for a months time. send him a notice and then if he pays withdraw the case.

You should take action within limit of time for the case.
