Legal Question in Criminal Law in India

I have given Rs.8 lakhs as loan to my friend without any written document based on the promise that money will be returned within three months. But he did not pay the money back.On repeated demand for money he had issued three cheques for total amount of Rs. 8 lakhs. When the cheques were presented to bank they were returned for reason like account closed and signature not matching with specimen signature. Now he is refusing to return the money. I could not take action against him u/ s 138 Negotiable Instruments Act as it is time barred now. When I preferred complaint against him in Police they are refusing to take action against him u/s 420 IPC citing that it is a case comes under Negotiable Instruments Act and not u/s 420 IPC. Kindly clarify whether my friend can be prosecuted under sectin 420 IPC in this case. What is the legal remedy available to me to get back the money.
