Legal Question in DUI Law in South Africa

Hi. I was arrested last year for DUI. I'm pretty sure I was just just over the limit and I am due to appear in court in June this year. I just want to know if it is absolutely necessary to get a lawyer for my first appearance or should I first go in alone and see what the lab results are that came back and then take things from there?

There is no need to instruct an attorney right from the start. However, when you appear in court on your own, one has to be wary not to be taken advantage of by some unscrupulous prosecutors. As a rule of thumb, do not agree to any acknowledgment of guilt fines or anything prior to discussing it with an attorney.

As far as court dates are concerned, if the matter proceeds, be sure to not set the matter down for trial without your attorney (if you choose to have an attorney), because the chosen date might not suit your attorney. Rather, if it becomes clear that the matter is proceeding, arrange for a provisional date for your attorney to be present to arrange a trial date himself.
