Legal Question in Family Law in India
20 years ago my father filed for legal separation with my mother, after she caught him cheating and won as my mom had lost her sanity temporarily due to shock, they have been living separately since.
Last year after her demise, he has been claiming as part inheritor to her FDs to which there is no nominee.
He has also claimed and is availing her pension, to which she said earlier that she has not named him benefactor during her retirement.
I want my mom to get justice. Please advise.

If they had just separated judicially then he has a right to claim, but if they had divorced then he does not have any claim. As regards pension, kindly visit her office and apprise the concerned officer of the facts. You may drop in a detailed query at [email protected]
