Legal Question in Family Law in Pakistan
AoA. i am father of 7 year old son and doing visitation in court premises after khula. Now I filed a case for the custody of my son at 7 and trial court gave a biased decision as the counceler (Ex civil judge) of my ex wife approached the judge. Malafidy to such an extent that income evidence was not shown or asked but it is written in judgement that she is from a reason able family with good income. In judgment it is written that this fact has been accepted by me in cross examination where it is totally wrong.
please advice can i give an application to the district and session judge or go in appeal that case be ref back to trial court and deputed to neutral judge as decision being made on malafidy?
