Legal Question in Family Law in Pakistan

AoA,

I have a baby girl of approx 2 years of age and living with her mother. I divorced her a few months back. I have filed custody case in guardian court and got visitation right of 1 time every month. My lawyer says that we should withdraw the custody part of the case and keep the visitation rights part as the baby is very young and we'll lose the custody part anyway. So, it is better to file custody part again when the baby becomes older or her mother does second marriage, etc.

Now I have heard rumors that my ex-wife is trying to go abroad (for studies or for job) with the baby so I that she can keep the baby away from me as my meeting with her can create hurdles for my ex-wife. So, I won't be able to meet my daughter anymore. Is this possible?? Will the court allow my ex-wife to take the baby abroad without my consent? I'll lose the right to meet my daughter in this case. Can court make such decision?

She has also filed a case of child maintenance on me. What will happen to this case?? Shall I have to pay maintenance every month even if my ex-wife takes the baby abroad and away from me?? This seems very cruel to me if courts allow such things here in Pakistan.

I'll really appreciate if someone can tell me if this could happen or not.

You can prove that welfare of minor is not as per law with mother that he is student or doing job

This is not simple rule that minor is under age.

You must file application in court that your ex want to fly abroad and request to the court that name if minor should be enter in ECL.

If she can succeeded to fly then you will not be responsible for child maintaince
