Legal Question in Family Law in Pakistan

Assalam-o-Alaikum

I had married with a lady who was divorced (with one Son) few years back. We have a daughter aged 3.5 years now. My wife is not willing to leave her job & city and not agree to live with me in another city where I am having a good job. She is living with her divorced mother since she was a child and not willing to leave her.

Another matter which is an issue between us is that she is not willing for another child

I am fed up of this situation and thinking about the 2nd marriage. What the law says about it if I opt to have second wife without knowledge of first wife.

What if I give divorce to my first wife, is there a way to have daughter in my custody. What are the other obligations if I chose this option to divorce her?

If you go for 2nd marriage without permission then legally there's punishment which may extended to 1 year and fine as well but there's no harm under Shariah.

You have a strong case to get permission for the 2nd marriage from the arbitration council without divorcing your 1st wife on the ground that she is not performing her matrimonial duties.

But if you divorce your wife then at this stage it's very hard to get the custody but your visitation right would be granted.
