Your sitaution is not particularly difficult.

Have your fiance file for divorce here in California and serve the spouse in the Philippines. As soon as the divorce is final you can then legally marry.

To legally marry her she would first have to be divorced. Since she is a resident of the State of California, she can file for sissolution of marriage here.

You may problems in securing an Affidavit of legal apacity in the Philippine Embassy for your Filipina fiancée.

I suggest that your fiancée should file a Petition for Annulment of her previous marriage here in the Philippines.
