Legal Question in Family Law in Pakistan

I got divorced (Khullaa) in 2008 and it is clearly mention in my divorce deed, "That it is expressly agreed that the right to retain custody of all the children shall vest exclusively in the Second Party (i.e., myself, the mother of the children) who shall be responsible for raising the children entirely from her own resources and without recourse to the First Party (the father of the children)."

So, I have been raising my children from my own resources since my divorce without a single penny offer from their father ever.

I got the divorce deed attested from an Advocate HIgh Court, Notary Public, Lahore in 2008. But today, I went to get my children's passports renewed and the officials there refused to accept my divorce deed and asked me to provide a guardianship certificate and also get my divorce deed attested from the High Court.

My question are:

1. how to proceed with the attestation of divorce deed from High Court?

2. How and where to go for Guardianship Certificate?

3. How long does it take to acquire a Guardianship Certificate?

You can file an application before guardian court to obtain guardian certificate.

It will take 3months maximum if not agitated by opponent side.

Request of attestation by High Court is strange and non practical, though i suggest u to get divorce effectiveness certificate from concerned union council or ward where nikah is registered. That would be sufficient.

Dear you can file petition for grant of guardianship certificate. And you can get attested copies of your divorce decree which has been passed by the competent court.

for the guardianship certificate you wl have to move the guardian court of your local jurisdiction . for divorce certificate , there are secretary of local union council. to discuss in detail you can contact during 2 pm to 6 pm through phone: 0323 4638149.

You may file an Application for permanent Custody and Appointed for Guardian from the court of Guardian Court of your jurisdiction and obtain a certificate and it will take around 2-3 months for getting the guardianship certificate smoothly, if the other party appeared and contest the applications, it might take long time and it depends on your proposition and circumstances of the case.

Request of attestation by High Court is strange and non practical, though i suggest u to get divorce effectiveness certificate from concerned union council or ward where nikah is registered and if you want to take the certified copy of your Khula decree, then you may approach to the court who had passed the Khula decree in your case.
