yes, you can file get her brother evicted from your house in Pune and at the same time, you can avoid maintenance in case you able to prove that it is she who is staying away from you without any sufficient cause. you may defend your case even though you outside india by executing a power of attorney duly attested by notary public or indian consulate.

Dont come else it wii be easy for her to approach you. Else it will be dificlt to serve the summons. for her brother you can evict him immedeatly or there are many means by which you will throw him out of your house..
