Legal Question in Family Law in United Arab Emirates

Hello,

I got married in the UAE in 1999, I am Austrian and my husband is a UAE citizen. I moved back to Austria many years ago and he stayed in the UAE, we are separated. What is the procedure if he wants to get a divorce in my absence (I don't want to travel to the UAE again)? Is it enough to pronounce the talaq in front of witnesses and register this in the court?

Hi,

You have not mentioned your religion. However as your Husband is an Emirati and presuming him to be Muslim by religion, for obtaining Divorce your presence is not really necessary. He can approach the local Court and obtain an Divorce Order even in your absence.
