Legal Question in Family Law in Pakistan

Hi,

Please see my case and advise as I want custody of my daughter:

I want to get divorced (khula most probably) from my husband. He says that he will not let me take my daughter who is 4 years old with me. I intend to Inshallah get divorced and marry a man of the same sect and better social standing who is already married with children, as a second wife. I am willing to allow complete visitation rights to my husband for his daughter. I am a working woman but am willing to quit my job if required. My second husband to-be is willing to take complete financial responsibility for my daughter's upbringing with or without my quitting the job.

Please advise if I can keep my daughter till the age of adulthood.

Dear you can get custody of your daughter as well as maintenance allowance of your daughter from your husband.

You have legally protected rights for getting divorce on the basis of khula.

after getting divorce from your husband, you can file a case for the custody of your minor daughter, in which you just have to prove that the welfare of the kid lies with you and not with your husband because the only point of consideration for the court is Welfare of Minor before handing over the custody to the applicant.
