Legal Question in Family Law in India

My husband stays in Dubai. We have made a separation agreement three years before.. But after few months I have filed a dv case against him.. Till he has not turned back. Now I want proper divorce. My husband can not come to India as he doesn't have visa. He has got a ban on his visa. Now since Last one year he stays in some free zone called jable Ali where visa is not required .. Its an illegal residence. In such case what is the procedure to get proper divorce signed by him.. Or else any other option.. ??? Can his parents give in writing of having no objection if I get married to someone on my husband's behalf??? Which different legal documents to be made for not having problem in future in this regard ??

Hi,

From the contents of your Mail it is presumed that you are staying in India and have filed for Domestic Violence Case (hope it is right) in India. You would have to file proper Divorce case before the jurisdictional Court in India in order to obtain Divorce and you may ensure to serve Summons on your Husband.

I may be right, if I say that your Husband would be having valid Visa to stay in Dubai and it is only that his Visa now must be from some Company functioning in the Jebel Ali Free Zone.

You may have sought the assistance of some Lawyer for filing the DV case so you can ascertain and understand from him the procedure for filing Divorce case.

Dear client u cannot marry without divorcing first husband. If u do so then u will prosecute for bigamy and will punish for five years jail. U have to file divorce in court on the ground of desertion and court will send notice to yr husband. If yr husband will not come then court will give u ex party divorce.
