Legal Question in Family Law in India

hi

i am married from 2004. I have a son. I am living in Kolkata. I have problems from the marriage but the problems like abusing, insulting to take name of my male friends and cruelties and mental harassment from my husband are more in two years. But i compromised how much i could do .

My parents tried to solve the problems many times. But our relationship get worst as per day . And i am nt able to live with him any more .

And i left home and living in pg hostel.

I have no money and my husband also not giving me.

My parents and husband are not agree for the divorce. But i cannt live more with him. My son lives with him. And he says that i never can be divorce .please tell me what i can do and how can i fight a case for the divorce.

Dear client if husband is not ready for divorce then file contested divorce on the ground of cruelty. First file complaint with women cell of police against husband under sec 498 a for physical torture. U can ask maintenance from husband by filing case under sec 125 of criminal procedure code. 1) File DV case and 498A and seek maintenance followed by Divorce case.
