Legal Question in Family Law in India

Hi Sir,

I want to visit the child during the visitation order by court. But the custodial parent not bringing the child during visitation hours. It happened for 3 times already (out of which they brought the child only for the second time (1 out of 4).

Can you please answer me the below questions?

1) What kind of proof should i give for their absence? Should i give the copy of the register?

2) Also shall i ask for the compensation for the hours? If so, will the judge consider the request?

3) How long will it take for the judgement, if i make application for the contempt of the court?

4) Is there any maximum count for the non-availability for the visitation, the court requires?

5) How shall i say to the court, if they can provide some untrue reasons like bad health or functions?

2) Yes. Any other tangible evidence available.

3) Cant say. It depends. Move urgent motion.

4) The other side will be given opportunity to explain failure to comply court orders.

5) Ill health etc will be supported by medical records and if need be will be referred

to Medical Board.

6) Discuss with ur Attorney who will guide step by step.
