Legal Question in Family Law in India

Hello Sir/Madam,

My aunt's (mother's sister) son is a drunkard. He manhandles his parents and abuses a lot. They lodged a complaint on their son, but the policeman are keeping him in the jail for few hours and leaving him saying that they wouldn't keep any person in the jail in the night until that is a serious criminal case, as they are worried regarding the suicide attempts. They come promptly and take him away from the house and leaves him in the night. This is ongoing and my aunt's son is now not afraid of the police also. He takes away whatever is handy and sells it in the market for a second hand. If any neighbor tries to help them, he is trying to fight with them also. Some of the policemen are asking them to join him in a mental care hospital as they would treat for his psychic behavior. My aunt is not understanding what to do..He is unmarried, now 33 years old, he was put in rehabilitation center also for about 16 months, but after that course, he was fine only for three months and then came back to normal. She is suffering physically and mentally for the past 13 years. He is not afraid of the police, neither he is ready to go to mental hospital as that would leave a remark for his entire life. What should my aunt to get rid of him or how can she get him into a proper way to lead a normal life??? Please answer.

as a lawyer we can give you legal advice not the one relating to social behaviour. If the boy has a mental health problem he needs to be treated urgently .They can approach the police for the assistance to get him admitted in the hospital.

Any Psychiatrist has the power by virtue of the Mental Health Act to take any one to a Psychiatric home, with consent of the parents of the patient. Please meet a Psychiatrist and ask him to take him to a Psychiatric home. You may drop in a detailed query at [email protected]
