My wife claim for maintenance u/s 125, In her petition she has shown that I am a Railway Contractor, Rly. computer supplier & my monthly income is more than Rs. 1,00000/-(one lack). Which is 100% false. Actually i m a daily wager & earn Rs.3,000 p.m., on the other hand, I m suffering various disease since last 1 year and my mother is also suffering bone disease since last 15 yrs. & the treatment is going on till now. She cannot move due to her backbone band. So it is not possible for me to bear maintenance. My wife is staying in her parents house last 1 year. My wife is a hose wife but her father is a Railway service man & getting good salary from Rly.deptt. My economic condition is very bad. So tell me what can be done ? she is not divorcing me. she wants money only. I want to relief from maintenance charge.(the case is running last 5 months ago).

see you cannot escape paying the maintenance to the wife. you can prove your income by filing the necessary documents in the court. your responsibilities cannot save you from paying maintenance. You can file a petition for restitution of conjugal rights.
