First of all, where are you actually living? If you are living in Mexico, fine; I presume you are Mexican, yes? On the other hand, if you are living in California, and you do not have any legal status, how are you getting down to Mexico and getting back to California, if that is what you are doing? If you are not U.S. citizens, or lawful permanent residents of the U.S., then there are only a few possibilities that allow you to live in the U.S. Either you obtain a relative visa petition or you have a prospectivce employer petition for you. Since you work in Tijuana, I guess from what you have advised, you prefer to continue working in Tijuana. Then the only other possibility would be someone who could petition for one of you. It's not that easy.

You might have several options mostly based on employemnt in the U.S. If you do not want to work in the U.S., an EB-5 might be an option.

You need permanent residence for what you want to accomplish in all likelihood. Best to be in touch with me directly to specify more details in order to be sure. I practiced law in San Diego for many years and frequented the U.S. Consulate in T.J., so I'm quite familiar with the "landscape."
