Legal Question in Intellectual Property in India

hi we are establish a partnership firm Jun 2014 .we are mention a business for mobile accessories partnership deed . And apply for trademark on the basis of partnership deed. After 2 year my friend was not interest in this partnership, and trademark name is pending. Please suggest me how i only use this trade mark, the show objected because maybe he will claim that he is also owner of this trademark.

1) Any person, claiming to be the proprietor of a trademark used or proposed to be used by him, may apply in writing in prescribed manner for registration.

2) If the Partnership firm with two partners has claimed Trade mark registration, when once the firm is dissolved, the Trademark registration also follows.

3) U hv to file with the Registrar to remove the same from the records. Since it is already two years, if it is not objected and a straight case, the TM must have been registered by now.
