This is a Immigration issue and you should consult your INS agent before leaving the country. As far as India local law is concerned, contact your local attorney to inquire if he could make appearances in India for you. Good luck!

Thank you for your email. You may marry your fiancee and adjust status (file for your Green Card) while here in the U.S. You may also file for work authorization (allows you to work for any employer - not just the employer that has sponsored your H-1B) and advanced parole (this document will allow you to travel while your Green Card is pending). This way you may travel back to India per the court order. You may then re-enter the U.S. on your advanced parole document. This way you will not have to until after your trip to India to apply for a green card.
