Legal Question in Employment Law in India

Dear Sir,

Firstly thank you for spending sometime to answer. We know that Jan 26th, Aug 15th & Oct 2nd are national holidays. As per the constitution of India, do we have any laws supporting that these are mandatory national holidays to be declared as a holiday or can we compensate these holidays with any religious festivals. Also, please let me know the minimum and maximum number of public holidays and optional holidays to be declared in IT sector.

Dear Sir / Madam,

If you are employed in an Indian Company or in any subsidiaries of the Company anywhere in the territorial waters of India. there are only two national holidays and not three ... 26th January - Republic Day and 15th August - Independence Day of every year. As regards other holiday entitlements, they will be specified in your offer / appointment letter, the general norm being 4 or 5 Casual Leaves, 10 Sick Leaves and 30 days annual paid leave, and 12 weeks maternity leave divided into 6 weeks prenatal and 6 weeks post natal; unless otherwise stated in the Company's policy document.
