Legal Question in Employment Law in India

I am a Development Officer in LIC. In 2009 LIC imposed a new law Special Rules 2009 for development officers cadre only. According to this law dev. officers who have cost ratio above 38% for more than two consecutive years will be terminated from the service. This law has created havoc in our cadre and many dev officers are terminated on this ground and many are under danger zone. we are very anxious regarding our job security and we want to challenge this law in the court of law. we seek legal advice from you. on which ground should be challenge the law. LIC is a public sector organisation wholly owned by Government of India. Dev officers are considered whole time salaried staff of LIC. what should be do and on which ground should we challenge this law so that our job gets secured.

Dear Sir / Madam,

Development Officers are engaged by LIC purely to develop business for the Corporation. And only if you bring in business, will LIC pay you for it, and you remain on the assignment. Otherwise, Development Officers will not bring in any business, and still be paid, which will be an unwanted cost burden on the Corporation. LIC's business mantra is simple : "Perform or perish". Challenging the new law will prove to be futile.
