Legal Question in Employment Law in India

Sir

I was working in a corporate for last 7 years. But in last july company had sent me a show cause notice, which I have replied with supply of evidence. Company stopped my salary without any intimation.Since then I have stopped from office going with a leave application for 20 days. Now in this last 5 months company served notice for domestic enquiry twice for which I have replied to attend the enquiry if my salary is paid. Present status is I have neither resigned nor the company has terminated me. Please guide me now what I should do?

Dear Sir / Madam,

You are the loser in the bargain. If the inquiry against you is still pending, the Company will not pay your salary. The Company is also holding all your dues like PF, Gratuity etc. Therefore, it is in your interest to attend the inquiry and get yourself absolved from it and to resume duty if you are interested in the job. If not, you should tender your resignation and ask the Company to pay you your full and final settlement dues.

Regards,
