Type your question here...dear sir, please confirm at the time of my joining my noticer period was 1 month as per my appointment letter and offer letter , now they have sent mail to serve 90 days or relieving letter will not be issued. please suggest whether i am bound to serve 90 days notice period or 90 days salary to the company. In case i don't serve the notice period even for a single day then what kind of legal action company can take on me. also whether i am bound to pay 1 month salary as my paid leaves are balance with the company.

Dear Sir / Madam,

NO. Since your offer letter and appointment letter clearly specify 30 days notice period, you are not legally bound to serve 90 days notice in the Company. All your balance earned leaves can be adjusted against the notice period, and you are legally bound to serve only the net notice period after adjusting all earned leaves therefrom. The Company has no grounds to take any legal action on this settled issue.
