Legal Question in Employment Law in India

i am working in a MNC Messer cutting systems.

In my appointment letter there is no 3 months notice period.

But my HR is saying that the company policy is like that 3 months notice period, so you have to serve 3 months or to pay for 3 months.

Also, she is refusing to give me the company policy ?

what can be done ?

Dear Sir / Madam,

The Notice Period as mentioned in your Appointment Letter will legally prevail. If the Notice Period in your Appointment Letter reads "one month" and the Company at a later date after your joining (as per HR's claim) revised the Notice Period to "three months", it will not apply to you. Make it clear to HR that the Notice Period as mentioned in your Appointment Letter will only apply to you.
