Legal Question in Employment Law in India

I was working in private company and I worked there since last 2 months. After that I realised company is not capable to disburse the salary to employees on time and tow months passed and I didn't get my outstanding salary. So I left the company and informed to owner to fnf. I had a company vehicle that was given to me for site visits that I had and wrote a mess once you pay my outstanding amount, then after I will handover your vehicle. Regarding this I consulted with lawyer and my lawyer send a notice to owner by registery. Till now they didn't take any initiative to pay my amount. Is there any possibility that I shall be caused any guilty if he takes any legal legal action against me.

Pls guide for further procedings.

Dear Sir / Madam,

Your full and final settlement dues, if any, accrue to and are owed by the Company to you, only after you have returned back Company property. You are at risk of being proved guilty, and you remain liable to pay the damages for usage of company assets despite having quit the Company. In my opinion, you should return back the Company vehicle and get an acknowledgement thereon, and simultaneously request the Company to pay your full and final settlement.
