Legal Question in Landlord & Tenant Law in India

My mother name prema redij living with uncle name atamaram thathre and uncle has expired since uncle had no children her wife sushila thathre were with my mother prema redij and later stage sushila also died but before she dies he made an will on my mother name prema now we have two brother asked landloard to transfer the ownership on our name in pagdi system but he asked us to pay 1/3 amount of house market value i request ed landlord to take initial amount and transfer the bill on our name but he denies. i heard the said building in which we have house is about to go for redevelopment. my question is does the builder will take objection in giving the house to us in new structure. we have valid will with us on the country we also have electricity bill on my mother name almost 12 year ago done. ration card on my mother name. voter id on my mothers name. please advice.

Dear Sir / Madam,

You should obtain a Probate on the Will and request the landlord to transfer the tenancy in your mother's name. You will need the consent of the landlord for the transfer of the tenancy in your mother's name before the building goes in for redevelopment.

Once the Property is transferred in your mother's name , builder will provide you the re-developed property accordingly.
