Legal Question in Landlord & Tenant Law in India

Sir/Madam, My flat in Chennai was rented to a person who claimed himself to be employed in an institution under a rental agreement for 11 months, after getting a deposit of 8 months rent.He was not regular in paying rent as well as the electricity consumption charges as required in the agreement>he is not keeping the flat neat and does not open it at all whenever I visit it.He stopped paying any rent for the past 8 moths and as on date his entire deposit will not be sufficient towards the arrears. I had filed a civil petition in a local court 5 months ago and the tenant has not appeared for the summons/nor represented by a lawyer. The court is yet to give an exparte eviction order. The tenant, a bachelor staying alone in the flat, whom I think is unemployed is not also opening the door for my representatives either to see the flat/ prospective buyers/tenants/association office bearers etc.Can I take the help of police without any legal complications to get him vacated, as he is not allowing me even to enter/ inspect the flat during pendency of case in a civil court ?

1 Answer from Attorneys

1) Bring his suspicious activity to the notice of the court may be antisocial terrorist and seek direction

to the Police to inspect the flat.

2) On the basis of ur complaint also the Police in the presence of neighbors can break open

the lock and find out whether he is indulged in any illegal activities.

3) Get the evacuation order by filing out of order petition through ur lawyer.
