For Land dispute

I have 2 viswa land purchase last 30 year ago for making home.but now when i measurment through the Tehsildar official my land shift near the other man land under.he know that land is my but he do court case but he don't take stay for that land.but court case continue.I want to know can i make the home or not.because i have no livivng area.
