Legal Question in Product Liability in Germany

I am a co-developer at a start-up social-networking service. One of the key aspects of the service is complete privacy and no censorship. There is a private messaging system within the service that will image upload, and there is currently no Terms of Service agreement. I am afraid that illegal images may be placed on the server. All images are protected with 256 bit encryption, and they self-destruct completely after two weeks. Is it possible to create a Terms of Service agreement that removes all liability from the server, instead placing it upon the user? If so, how would I go about writing it? Otherwise, what is an alternative solution to this problem that does not violate users privacy and does not involve censorship? Thanks in advanced for the help!
