I want to buy a property in Surat. What kind of documents I have to look after I purchase the property. Please advise.

Sir

What kind of property are you planning to purchase in Surat. Is it Agricultural Property / Non Agricultural Property. Whether such property is within the limit of Surat Municipal Corporation or under the Authority of Surat Urban Development Authority (SUDA). Whether such property is private land or unit in cooperative society. Commercial Unit or Residential Unit.

Need to know all these questions, before can assist you, because status of each kind of land is different and so are its paper work.

In Agricultural Land, you must look for hierarchy of Village Form No. 6, 7/12, 8A. These are prime documents. Also, if the land is new tenure or old tenure land. If it is new tenure, then you cannot purchase it without converting into old tenure and obtaining permission from collector.

If it is Non-Agricultural Land then you need to check, if land is properly converted in to Non-Agricultural Purpose and order under S. 65 is property passed and mutation entries are affect. Also, if the construction is done after taking proper approval from SUDA.

If land is within area of Corporation, then need to check the Property Card Registers, City Survey Offices Registry.

If it is cooperative society, then need to check if cooperative society has proper title to the land, the bye laws, registration of society. share certificates.

Over and above all, the general regulations are, you must carry out search with the concerned Sub-Registrar Office of the last 30 years record, to verify if any kind of previous deal / transaction / encumbrance is already recorded.

Also must give news paper publication regarding any objections from third party. This is standard protocol.
