Dear sir, my father shifted from Bihar to Delhi in 1975 and we have some ancestral land in Patna town (Nagar Nigam). We planned to dispose that land so that we could get some land in Delhi but my uncle (elder brother of my father) wants to get my father's partition in very cheap price. Can my father sell his share of ancestral property without consent of his elder brother?

If the property is divided and ROR are separated your father can sell it out,even thought he can sell undivided share in the property.
